
Barry Mallen
Mr. Mallen has over 30 years’ experience litigating and trying media, entertainment, business and intellectual property disputes in the motion picture, television, recording, music publishing, concert, gaming, merchandising, advertising, sponsorships, sports, new media, technology, and banking industries. He serves on the Board of Contributing Editors for the industry publication Entertainment Law & Finance, and was the former Chair of the Media, Entertainment, and Intellectual Property Litigation Group of a large national law firm. Mr. Mallen has been listed by the publication Super Lawyers as a top Entertainment Attorney each year since 2004 and was a featured speaker at Texas’ Annual Entertainment Law Institute.
A recognized national expert in copyright litigation, Mr. Mallen has represented many of the major and independent record companies and music publishers in copyright infringement and copyright ownership cases, as well as having represented major artists such as the Rolling Stones, Mariah Carey, KISS, Kenny Loggins, John Fogerty, Kid Rock, Steve Perry, Bad Company, the Estate of Bob Marley and Brian Wilson in copyright and intellectual property disputes, and has lectured before the Association of Independent Music Publishers on issues related to music copyright cases. Mr. Mallen’s music litigation experience also includes trademark and band name disputes, band/partnership/corporate termination and dissolution matters, corporate governance issues, artist-manager disputes, disputes arising under California’s Talent Agencies Act, so called “seven year” disputes under the California Labor Code, name and likeness (right of publicity) disputes, and royalty examination and audit disputes. Recently Mr. Mallen has represented music icon Lindsey Buckingham in the dispute arising from his departure from the band Fleetwood Mac. Mr. Mallen has also represented some of the nation’s top concert promoters in contract disputes, as well as one of the leading performance rights organizations in contract and royalty disputes.
Mr. Mallen also has an extensive practice representing content creators, financiers, producers, production companies, studios, broadcasters, distributors, sales agents, and talent in copyright and idea submission claims, credit disputes, rights disputes, pay or play disputes, and profit participation and royalty audits, including audit claims and contract disputes involving the films and/or television shows “Gone with the Wind,” “Lord of the Rings,” “The Matrix,” “Good Will Hunting,” “The Expendables,” “Everybody Loves Raymond” and “The Golden Girls.” He also has a national practice representing banks, lenders, financiers, sales agents and distributors in film financing and distribution disputes, and has extensive experience handling arbitrations before the Independent Film & Television Alliance.
Mr. Mallen also represents businesses, companies, and entrepreneurs in a wide variety of commercial, business, and real estate litigation, including disputes involving claims for breach of contract, fraud, breach of fiduciary duty, unfair competition and business torts, professional negligence, partnership disputes, and minority shareholder claims and corporate derivative actions.
